Freddie Demond Heard Sr., AIS# 272097, an Alabama state prisoner has diligently tried to exercise his guaranteed fundamental rights pursuant to Section(s) 25 and 35 in the the Alabama Constitution(1901), injunction with the United States Constitution FIRST and FOURTEENTH Amendments. STATEMENT OF FACTS
Freddie Demond Heard Sr. sought clarity through a Freedom of Information Act request regarding procedures for citizen access to the federal grand jury. The United States Attorney for the Middle District of Alabama responded that no such records exist.
Additionally, Freddie Demond Heard Sr. attempted to arrange a meeting with the federal grand jury in Mobile, Alabama, which the Defendant evaded. Subsequently, Freddie Demond Heard Sr. filed a First Amendment Complaint (Case No. 2:21-CV-125-MHT-KFP, Middle District of Alabama).
In this case, Judge Myron H. Thompson referred to the lawsuit as "frivolous" without providing factual or legal grounds for this characterization.
Freddie Demond Heard Sr. appealed this decision to the United States Court of Appeals (Case No. 23-10651), where the court deemed the appeal frivolous and denied leave to proceed, ultimately dismissing the appeal.
On September 27, 2023, Freddie Demond Heard Sr. called upon United States Representative Barry Moore to introduce an impeachment bill against Judge Myron H. Thompson, citing concerns over restricted court access for American citizens. See supporting documents below for details.
To this day, United States Representative Barry Moore has remained silent in response to Freddie Demond Heard's urgent request. Both Judge Myron H. Thompson and Representative Barry Moore are bound by their oath of office to uphold the Alabama Constitution and the United States Constitution, which unequivocally state:
The Alabama Constitution (1901), Section 25, affirms the right to peacefully assemble and petition for redress of grievances, asserting "the citizen has a right, in a peaceable manner, to assemble together for the common good, and apply to those invested with the power of government for redress of grievances or other purposes, by petition, address, or remonstrance."
The United States Constitution mandates that the Alabama Constitution (1901) aligns with its First Amendment, ensuring "Congress shall make no law... abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
Furthermore, the Alabama Constitution, in tandem with the United States Constitution's Fourteenth Amendment, imposes an essential obligation through officials' oath of office to all citizens within Alabama, stating "All persons... shall not be deprived of life, liberty, or property, without due process of law, nor denied equal protection of the laws."
Freddie Demond Heard Sr. has been unequivocally denied his fundamental rights by Judge Myron H. Thompson, and now by United States Representative Barry Moore.
